Law Society Regulatory Proceedings for October 2013

The Law Society’s Hearing and Appeal Panels recently heard the following matters. Hearing and Appeal Panels are responsible for determining the appropriate disposition of cases.

Dorothy Elizabeth DeMerchant (1984), of the City of Toronto

Decision: The application was dismissed.

Roy Francis DMello (1998), of the Town of Oakville

Decision: The Lawyer’s appeal from the Order dated December 7, 2012 and the          Decision and Order dated December 11, 2012 was dismissed.

Jason Richard Forget (2003) of the City of Peterborough

Decision: Commencing on October 1, 2013, the Lawyer’s licence is suspended on an interlocutory basis.

Yuri Gavris (2008) of the City of Toronto

Decision: A reprimand was ordered but not administered as the Paralegal would not sign the waiver of appeal.

Allison Frederick Gowling (2008) of the Community of Jarvis

Decision: The Paralegal was found to be ungovernable and his licence to provide legal services was revoked effective October 7, 2013.

Matthew Joseal Igbinosun (1998) of the City of Toronto

Decision: The Lawyer’s one-month suspension will commence on December 2, 2013.

Don Philip Kirsh (1988) of the City of Toronto

Decision: The Application was converted to an invitation to attend. The Application was dismissed.

Peter Knezy (1998) of the City of Toronto

Decision: The proceeding with respect to Particulars 1 and 2 was converted to an Invitation to Attend and the Invitation to Attend having been completed, Particulars 1 and 2 were dismissed.

Brian Allan Ludmer (1987), of the City of Toronto

Decision: The Lawyer was suspended for a period of two months and then for an additional one month to be served consecutively to the two-month suspension. The suspensions will start on November 2, 2013, or a time agreed upon by him and Society counsel. The Lawyer and his practice are subject to specified conditions.

Kym Lee McGahey (2000) of the Community of Kemptville

Decision: The Lawyer’s licence will be suspended for a period of one year, continuing thereafter until specified conditions are met.

Henryson Emeka Nwakobi (2008), of the City of Toronto

Decision: The Lawyer may resign his membership and surrender his licence on condition that he takes such steps not later than 10 calendar days after release of the reasons for          Decision in this matter, failing which, his membership in the Law Society shall be terminated and his licence to practise law shall be revoked effective immediately after 10 calendar days following release of the reasons for        Decision in this matter.

Victor Nnamdi Opara (2005), of the City of Toronto

Decision: The application was dismissed.

Allan Barry Shusterman (1978) of the City of Toronto

Decision: The Lawyer was suspended for one month commencing on November 1, 2013.

Joseph Nathan Solomon of the City of Toronto

Decision: Further to the July 22, 2013       Decision and order granting Mr. Solomon a Class L1 licence, the hearing panel imposed conditions.

Darren Elliot Sukonick (1996), of the City of Toronto

Decision: The application was dismissed.

Leslie Andrew Vandor (1982), of the Community of Almonte

Decision: The appellant Lawyer shall pay to the Law Society costs in the amount of $25,000.
